Cancellations by the customer<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Cancellations made by the customer will be subject to the following conditions:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Cancellation 7 days or more in advance: refund of 100% of the amount paid.<\/li><li>Cancellation between 7 and 4 days in advance: refund of 50% of the amount corresponding to the rental.<\/li><li>Cancellation less than 4 days in advance: no refund will be issued.<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The time periods will be calculated using the scheduled date and time for the start of the contracted service as a reference.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Failure by the customer to appear on the reserved date and time will be considered a late cancellation and will not entitle the customer to any refund.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">2. Weather conditions and sea state<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The existence of unfavourable weather conditions does not, in itself, constitute grounds for cancellation, nor does it automatically give rise to any right to a refund.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The feasibility of navigation will be determined using objective safety criteria, taking the following into account together:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>The official AEMET marine forecast for the navigation area and time.<\/li><li>The wind speed and direction according to the Beaufort scale.<\/li><li>The sea state and significant wave height, using the Douglas scale as a reference.<\/li><li>The direction, period and characteristics of the swell and the presence of ground swell.<\/li><li>The presence of strong gusts, storms, reduced visibility or other phenomena that may affect navigation.<\/li><li>The design category, characteristics and technical limitations of the vessel.<\/li><li>The planned navigation area and route.<\/li><li>Any warnings, restrictions or prohibitions established by the Harbour Master (Capitan\u00eda Mar\u00edtima) or other competent authority.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">3. Vessels up to 5 metres in length and up to 15 HP<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">For safety reasons, the following specific operating limits are established for vessels up to 5 metres in length equipped with engines of up to 15 HP:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Wind:<\/strong> navigation will not be authorised when conditions reach Beaufort 4 or higher, equivalent to sustained wind of 11 knots or more.<\/li><li><strong>Waves:<\/strong> navigation will not be authorised when the forecast or existing significant wave height is equal to or greater than 0.50 metres.<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Reaching just one of these limits will be sufficient to suspend, delay or cancel the departure for safety reasons.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Likewise, even if these limits are not reached, navigation may be suspended when other objective circumstances arise that may compromise safety, such as wind gusts significantly higher than the sustained wind, ground swell, storms, reduced visibility, adverse weather developments or restrictions imposed by the competent Maritime Authority.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">4. Other vessels<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">For vessels not included in the previous section, the feasibility of navigation will be determined taking into account the wind speed and direction, sea state, wave height and direction, design category, engine power and particular characteristics of each vessel.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As a general rule:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Beaufort 0 to 3 (up to 10 knots):<\/strong> conditions normally compatible with navigation, provided that the sea state and other circumstances are suitable.<\/li><li><strong>Beaufort 4 (11\u201316 knots):<\/strong> navigation may take place when the sea state, wind direction, waves, visibility and vessel characteristics allow the activity to be carried out safely.<\/li><li><strong>Beaufort 5 or higher (from 17 knots):<\/strong> a specific assessment of the conditions will be carried out and the departure may be suspended, delayed, limited or cancelled when conditions may compromise the safety of people or the vessel.<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Under no circumstances will a departure be authorised when conditions exceed the limits corresponding to the design category or technical characteristics of the vessel, or when there is a prohibition or restriction from the competent Maritime Authority.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A vessel\u2019s design category establishes its technical design limits and does not mean that all conditions within those limits are necessarily suitable for its operation as a rental.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">5. Weather warnings<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The existence of an AEMET weather warning will not automatically entail the cancellation of the booking.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It will be checked whether the phenomenon giving rise to the warning actually affects the specific navigation area, the time slot of the booking and the wind and sea-state conditions expected during the service.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When there is a navigation prohibition or restriction from the Harbour Master (Capitan\u00eda Mar\u00edtima) or other competent authority applicable to the vessel, area and time booked, the departure will not take place.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">6. Criteria for determining the feasibility of the departure<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">To determine the navigation conditions, the official AEMET marine forecasts for the area and time slot of the booking will be used as a reference, together with the actual conditions existing at the time of departure and, where applicable, the warnings or instructions of the competent Maritime Authority.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The decision to carry out, delay, limit or suspend a departure will be made in accordance with the objective criteria established in these conditions and will be based on reasons of maritime safety.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The safety of people and of the vessel will prevail at all times over the provision of the service.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">7. Cancellation by the customer due to weather conditions<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The customer\u2019s subjective perception of the weather conditions does not, in itself, constitute grounds for cancellation with the right to a refund.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The presence of clouds, temperatures lower than expected, light rain, wind, waves or other weather conditions that are within the established safety limits and allow navigation to be carried out safely will not entitle the customer to cancel the booking free of charge.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If, in accordance with the objective criteria established in these conditions, navigation can be carried out safely and the customer voluntarily decides not to use the vessel, this decision will be considered a cancellation by the customer, and the corresponding general cancellation policy will apply.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">8. Cancellation for maritime safety<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">When weather or sea conditions do not allow the activity to be carried out with an adequate level of safety in accordance with the criteria established above, or when there is a prohibition or restriction from the competent authority, Albor\u00e1n N\u00e1utica &amp; Charters may cancel, delay or postpone the departure.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When the departure is definitively cancelled by Albor\u00e1n N\u00e1utica &amp; Charters for reasons of weather or maritime safety, the customer may choose between:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Changing the booking to another available date, with no penalty, or<\/li><li>Receiving a full refund of the amount paid.<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Under no circumstances will penalties be applied to the customer when it is Albor\u00e1n N\u00e1utica &amp; Charters who determines, in accordance with the objective criteria established above, that navigation cannot be carried out safely.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>CANCELLATION POLICY AND WEATHER CONDITIONS 1.
